On December 22, 2017, the Tax Cuts and Jobs Act ratified by Congress enacted a new section of the Tax Code (26 U.S. Code § 1400Z) that provides tax incentives for investments in targeted disadvantaged areas in the United States through Opportunity Funds. This legislation had bi-Partisan support and was proposed by Senator Tim Scott (R) and Cory Booker (D) in 2016 and by Congressmen Pat Tiberi (R-Ohio) and Ron Kind (D-Wis.) in the House. The purpose of the Opportunity Funds is to promote economic re/development of these communities, known as Opportunity Zones. The program offers investors substantial federal tax advantages - deferral of Capital gains and also No Capital gains on any appreciation (certain holding period and other requirements apply).
